根據《物業轉易及財產條例》（香港法例第219章） 第3條，除非土地（包括房屋 / 樓宇單位 / 大廈）買賣合約是以書面訂立，否則法庭不會審理與土地買賣有關的法律訴訟。換言之，如果閣下透過口頭協議買賣一個物業，便得不到法律的保障。
儘管臨時賣買合約寫有「臨時」一詞，但一份妥善簽署的臨時賣買合約實屬有法律約束力的合約，而買賣雙方必須遵守有關條款。如果雙方未能簽訂正式買賣合約（以取代臨時賣買合約），他們仍可按照臨時賣買合約去完成交易或向對方追討賠償。
