如果買方有意購入的單位是負資產(售價未能完全抵銷未清還的按揭貸款),買方可如何減低風險?

因地產市場在 1997年後曾經急挫,買方必須向地產代理及賣方查問有關物業是否負資產 。

如是負資產,買方應與賣方商議在臨時買賣合約加入一條款,列明訂金由賣方律師保存而不會即時發放予賣方,直至賣方能證明未清還的按揭貸款不會超過售價餘款(即售價減訂金)。一旦賣方未能在交樓前解除現有按揭,上述條款能減少買方的損失。

如果賣方堅決拒絕加入這條款於臨時買賣合約內及/或買方願意承擔風險,則作別論。但任何面對此問題的買家應先尋求法律意見才作決定。
