大廈公契及業主立案法團

大廈公契(簡稱「公契」)的條款對多層大廈或多單位樓房內的各個業主均有約束力。當發展商與首位業主簽訂公契後,其後的業主都受該公契約束。基本上,公契會列明有關大廈的管理及居住 / 使用規則,而一份詳盡的公契可多達一百多頁,其中的條款可能包括:

  • 住宅單位不可用作商業活動﹔
  • 界定大廈的公用地方﹔
  • 單位業主須遵守的規則(例如不可飼養貓狗)﹔
  • 如何聘用大廈管理人(或管理公司)﹔
  • 如何成立業主立案法團﹔
  • 如何為大廈保養或維修的問題作出決議﹔
  • 由誰人及如何決定管理費的金額。

不論如何草擬一份公契,其條款不可與《建築物管理條例》(香港法例第344章)的條文相違背。
